ยง 5.113.37 Executive Order-No. 113.37: Directing That the Adjutant General Order Into Active Service the Organized Militia to Assist Civil Agencies and Authorities in the State of New York in Security Efforts at Transportation Facilities, Bridges, Tunnels, Utility, and Communications Facilities, Public Events and Venues

WHEREAS, I issued Executive Order Number 113, dated September 11, 2001, declaring a disaster emergency in the State of New York, Executive Order Number 113.2, dated September 11, 2001, continuing Executive Order Number 113 and amending it to direct that The Adjutant General order into active service the organized militia to assist civil agencies and authorities in the State of New York in disaster recovery efforts necessitated by the disaster, and Executive Order 113.27, dated October 2, 2001, continuing Executive Orders No. 113 and 113.2 and amending them to direct that The Adjutant General order into active service the organized militia to assist in airport security operations; and

WHEREAS, on October 7, 2001, the United States began military actions against terrorist training facilities and supporting military infrastructure, requiring a heightened level of homeland security throughout New York State, including security at transportation facilities, bridges, tunnels, utility and communications facilities, public events and venues

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby continue Executive Orders Nos. 113 and 113.2, dated September 11, 2001, and do hereby continue Executive Order No. 113.27, dated October 2, 2001, except that such Executive Order No. 113.27 is amended by adding the following paragraph:

FURTHER ordered that The Adjutant General shall order into the active service of the State, for such period, to such extent, and in such manner as he may deem necessary, all or any part of the organized militia to assist civil agencies and other authorities in security efforts at transportation facilities, bridges, tunnels, utility and communications facilities, public events and venues, and other vital installations and facilities, as may be deemed necessary, within the State of New York.
